Missouri Public Defenders Must Take Cases

A three judge panel of the Missouri Court of Appeals has ruled that public defenders in Missouri cannot refuse to accept new cases, even if they are overwhelmed and underfunded.   Missouri is second-to-last in the nation for funding of its public defender system.  The Court ruled that a regulation promulgated by the Missouri Public Defender Commission could not override state law requiring public defenders to represent indigents accused of a crime.
